This privacy policy describes how your information is collected, used, and disclosed by our organization, Adaptive Insurance Agency, Inc., its subsidiaries and affiliates,  which provides services such as real estate brokerage, mortgage lending, property insurance and title insurance and escrow services.  If you are a California resident, please refer to this privacy policy – insert link here. We are committed to protecting your personal and browsing information and will take reasonable steps to ensure your information is handled according to the terms of this policy.

  1. Types of Information Collected

We may collect two types of information: Personally Identifiable Information and Non-Personally Identifiable Information.

Personally Identifiable Information (PII) is information that, on its own or in combination, can identify you. PII includes:

  • Contact information (e.g., name, address, phone number, email address).
  • Demographic information (e.g., date of birth, gender, marital status, Zip code, age).
  • Employment information, mortgage rates and payments, and financial account information.
  • Social security number, driver’s license number, and other governmental ID numbers.
  • Unique identifiers (e.g., your email address as a unique identifier in our record system).
  • Other personal information needed to provide you with services.

Non-Personally Identifiable Information (Non-PII) is anonymous data collected if you interact with our websites or with one of our applications. Non-PII includes:

  • Information provided by you through the website.
  • IP address or unique device identifier information. An IP address is a number automatically assigned to your device when accessing the Internet, allowing internet and application servers to identify your device.
  • Browsing history, such as the time and date of your visit and number of clicks.
  • HTTP headers, application client and server banners.
  • Operating system and fingerprinting data.
  1. How Information Is Collected

We collect information through various methods:

Directly from You: PII may be collected via applications, forms, and correspondence we receive from you.

Website Interaction (Automatic Collection): When you visit our website from your computer or mobile device, we automatically collect and store certain information available to us through your Internet browser or computer equipment to improve your website experience.

Browser Log Files: Our servers automatically log each visitor to our website and collect and record certain browsing information. This browsing information is generic and reveals nothing personal about the user.

IP Address: An IP or “Internet Protocol” address is a number that is automatically assigned to your computer whenever you access the Internet. Web servers identify your computer by its IP address. Your IP address and other site usage data are used to gather broad demographic information. This data helps us serve you by allowing us to understand how visitors use our websites. We normally do not link IP addresses to PII, which means that your session will be logged, but you remain anonymous to us. We can and will use IP addresses to identify you when we feel it is necessary to enforce compliance with our terms of use or to protect our service, website, customers or others.

Cookies: Our websites use “cookies,” small files stored by your browser to help keep track of your user profile. Our cookies do not collect PII. We use cookies to remember your personal profile for your convenience, to deliver content specific to your needs and interests, and to ensure you do not see the same ad repeatedly. We also use cookies to track user trends and improve areas of the website that our users find valuable. The use of cookies is an industry standard found at most major websites.

Mobile Application: When you download and use our mobile application (the “App”), it may request access to your mobile device’s global positioning system (“GPS”) location. The App uses this GPS location to deliver information about points of interest (e.g., open houses, homes for sale) near that location. This location information is stored on your mobile device, and we do not have access to or interact with that stored information. If you decline GPS access, you will not receive this precise information, but you can change settings later if desired.

  1. How Information Is Used

Information we collect is used for three main purposes:

  • To provide our products and services to you or a third party obtaining services on your behalf or in connection with a transaction involving you.
  • To improve our products and services.
  • To communicate with you and to inform you about our, our affiliates’, and third parties’ products and services, jointly or independently, or any account that you may have on any of our platforms.

Your email may be used as a unique identifier, to verify communications from you, and to send you newsletters, promotional offerings you request, or to tell you about changes to the website.

IP addresses and other site usage data are used to gather broad demographic information and help us understand how visitors use our websites. We normally do not link IP addresses to PII, so your session is logged, but you remain anonymous to us. However, we can and will use IP addresses to identify you when necessary to enforce compliance with our Terms of Use or to protect our service, website, customers, or others.

  1. When Information Is Disclosed

We may provide your PII (except consumer or credit reporting information) and Non-PII to various individuals and companies, as permitted by law, without obtaining your prior authorization. Laws do not allow consumers to restrict all disclosures. Disclosures of your PII may be made to the following categories of affiliates and nonaffiliated third parties:

  • To third parties to provide you with services you have requested, and to enable us to detect or prevent criminal activity, fraud, material misrepresentation, or nondisclosure. We partner with trusted business entities to provide you with the best products and services. When you indicate you want to receive a product or service, or contact a person or organization, we share the data needed for you to receive that product or service or make that contact.
  • To our affiliate financial service providers for their use to market their products or services to you.

This includes consultants who may need access to our database to perform their services for us, or outside companies contracted to administer our mailing lists or provide retail services. We may disclose your PII to comply with the law, government orders, court orders, or legal process served on us or to protect and defend our property, rights, or users.
  • To lenders, lien holders, judgment creditors, or other parties claiming an interest in title whose claim or interest must be determined, settled, paid, or released prior to closing.
  • Other third parties for whom you have given us written authorization to disclose your PII.

In the unlikely event that our organization merges with or is acquired by another business entity or some or all of its assets are acquired, your PII may be transferred in the transaction.

We may disclose PII and/or Non-PII when required by law or in the good-faith belief that such disclosure is necessary to:

  • Comply with a legal process or applicable laws.
  • Enforce this privacy notice.
  • Investigate or respond to claims that any material, document, image, graphic, logo, design, audio, video, or any other information provided by you violates the rights of a third party.
  • Protect the rights, property, or personal safety of our users, the public, or us.

We are concerned with the security of your information. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your PII. Additionally, we restrict access to nonpublic PII about you to those employees who need to know that information in order to provide products or services to you.  When using the website or transmitting PII over the Internet, we make commercially reasonable efforts using leading commercially available tools to safeguard the confidentiality of your PII and Non-PII, using devices like firewalls and Secure Socket Layers (SSL). Unfortunately, no data transmission over the Internet is guaranteed to be 100% secure. As a result, we cannot ensure the security of any information you transmit to us or receive from our online products or services. Accordingly, you transmit and receive information at your own risk.

  1. Choices With Your Information / Opt-Out

Whether you submit PII or Non-PII to us is up to you. If you do not submit PII or Non-PII, we may not be able to provide you with certain products or services.

The uses of your PII and Non-PII that by law you cannot limit include:

  • For our everyday business purposes – such as to process your transactions, provide you with services you request, maintain your account, respond to court orders and legal investigations, or report to credit bureaus. This also includes information that we are required to retain for legal and compliance purposes.
  • For our marketing purposes – to offer our products and services to you.
  • For joint marketing with other financial companies.
  • For our affiliates’ everyday business purposes – information about your transaction and experiences.

You may choose to limit our disclosure or use of your PII or Non-PII under the following circumstances (“opt-out”):

  • For our affiliates’ everyday business purposes – information about your creditworthiness.
  • For our affiliates to market to you.

To the extent permitted above, you may opt-out of the use or sharing of your PII or Non-PII by notifying us of such decision through the contact methods provided at the end of this Privacy Notice. We do not share your PII or Non-PII with non-affiliated third parties except as required by law or to provide services you requested.  If you take advantage of any email notification features on our websites, you will receive email updates as described. We provide you with the opportunity to opt-out of receiving communications from us. To remove your name from an email service, simply click on the “Unsubscribe” link at the bottom of the email and type in your information.

Regarding Cookies: You have control over cookies. You can manually delete cookies and/or change your browser settings not to allow cookies to be placed. Please be aware that some portions of the websites may not function properly, or your online experience may be disrupted, if you disable or delete cookies.

If you receive text messages from us, you may opt out of receiving future text messages at any time. To stop receiving text messages, reply STOP to any text message you receive from us. You may also contact us using the methods provided at the end of this Privacy Notice to request removal from our text message list. Please note that opting out of text messages may not opt you out of other forms of communication, such as emails or phone calls.

  1. Information From Children

Our websites are meant for adults and are not intended or designed to attract children under the age of thirteen (13). We do not knowingly or intentionally collect PII or Non-PII from children under the age of 13. If you believe that a child under the age of 13 has provided us with PII, please notify us immediately.

  1. Privacy Outside of Our Websites / Outside Links

While on our websites, you may choose to follow links to other sites. We are not responsible for the privacy practices or the content of any of those other sites. Be aware that other sites may collect data and PII and operate according to their own privacy policies and practices. Please remember that once you are outside of our website or websites, any information you submit is outside of our control.

  1. Data Enhancement

We obtain aggregated demographic information such as age, income, and household composition from our trusted business partners to better understand our customers and improve our products and services. This aggregated demographic information does not identify you individually.

  1. Surveys

While on the website, we may survey you for contact information, unique identifiers, and demographic information. You are never required to answer these questions. The information you submit may be used for analyzing overall website demographics, preferences and tastes, and similar “getting to know our customers” purposes. We may disclose this data to third parties in an aggregated form (such as summary reports for our advertisers) but never with PII.

  1. Personal Tools and Discussion Groups

Certain products on our sites allow you to store your PII for future use. We do not share this information with third parties, other than as set forth in this policy. We may offer Discussion Groups for the use of our users and prospective customers. We moderate these Discussion Groups that cover a wide range of topics. You should be aware that information disclosed in these Discussion Groups is made available to all Discussion Group members and thus becomes public information. You should exercise caution when deciding to disclose any PII.

By submitting PII and/or Non-PII to us, you consent to the collection and use of the information by us in compliance with this privacy notice. Any amendments to this privacy notice will be posted on the website. Each time you provide information to us or we receive information about you, following any amendment of this privacy notice, will signify your assent to and acceptance of its revised terms for all previously collected information and information collected from you in the future. We may use comments, information, or feedback that you submit to us in any manner that we may choose without notice or compensation to you. We reserve the right to change the information, features, products, policies, promotions, disclosures, and disclaimers on the website at any time. Please check the policy periodically for changes. The continued use of the website following the posting of changes to this Privacy Policy will mean you accept those changes.

Alternatively, we may give you notice by sending an email to the email address you provided us when registering. In the case of email, notice shall be deemed given 24 hours after email is sent. In the case of postal mail, notice shall be deemed given 3 days after the date of mailing.
